Introduction

This Privacy Policy (“Policy”) applies to the personal information that Lidl US, LLC and its affiliates (“Lidl,” “us,” “our,” or “we”) collects through your purchases, its website at , its mobile application (“App”), and any other website owned or operated by Lidl (collectively “Platforms”) that posts a link to this Policy. This Policy describes the personal information we collect, how it is used and disclosed, and the choices you have with regard to your personal information.

Please read this Policy carefully to understand our policies and practices regarding your personal information. This Policy may change from time to time (see “Changes to Our Privacy Policy”) and your continued use of our stores or Platforms after we make changes is deemed to be acceptance of those changes.

Personal Information We Collect

We collect personal information directly from you, including when you fill out our forms, sign up for our loyalty program, subscribe to our email communications, submit material, or otherwise communicate with us; automatically when you access the Platforms; and from our vendors and other parties. The types of personal information we collect about you may vary depending on how you interact with us.

The personal information we collect may include:

  • Contact information, including name, email, phone number, and physical address
  • Commercial information, including about purchases; food, store, and other shopping preferences; coupon and other reward activity; and shopping activities
  • Geolocation information, including derived from IP addresses
  • Demographic information, including date of birth
  • Contents of communication, including records and copies of correspondence, responses to surveys, and information provided via contact forms
  • Internet or other electronic network activity information, including IP address, device identifiers, Cookie identifiers, browsing history, search history, and information regarding interaction with the Platforms. For more information about this type of information, refer to the Cookies and Other Tracking Technologies section below
  • Audio, electronic, or visual information, including photographs you submit
  • Other personal information that you choose to provide to us, including your photograph or shopping list

If you use one of Lidl’s referral features, such as providing Lidl with a friend’s email address, Lidl may use the email you provide to send the recipient an email on your behalf. By using any such referral feature, you represent that you and the recipient are United States residents and that you have the appropriate rights to provide the recipient’s email address and to send the message.

Cookies and Other Tracking Technologies

As you navigate through and interact with our Platforms, we and our vendors may use cookies, pixels, SDKs, web beacons, and other online tracking technologies (collectively, “Cookies”) to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Platforms, including length and time of visit, and pages visited, referring websites, traffic data, logs, communication data, and the resources that you access and use on the Platform.
  • Information about your computer and internet connection, including your IP address, operating system, browsing history, browser type, device unique identifier, mobile network information, and device telephone number.
  • Information about your location, if we receive your consent and if your device is set to provide location information.

Currently, our Platforms do not recognize or respond to “Do Not Track” signals.

Although much of the information that we collect through Cookies is statistical data or other aggregated information, it may include personal information, or we may associate it with personal information we collect in other ways or receive from or through other parties. This information helps us to improve our Platforms and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size, usage patterns, and other information about how the Platforms are used and perform.
  • Store information about your preferences, allowing us to customize our Platforms according to your individual interests.
  • Speed up your searches.
  • Track interactions with the Platforms and develop inferences and analytics.
  • Deliver and tailor interest-based advertisements.
  • Recognize you when you return to our Platforms.
  • Protect our Platforms, combat fraud, and otherwise operate our Platforms.

Some content or applications, including advertisements, on our Platforms are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use Cookies to collect information about you when you use our Platforms or about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We use web analytics providers, including Google and Meta, to collect and analyze information about use of our Platforms, help us administer and improve the quality of the Platforms, and serve ads on our behalf across the internet. We’ve implemented Google Analytics Advertising Features such as remarketing with analytics, interest-based advertising, demographics and interests reporting, user segment analysis, and impression reporting. These providers may also collect information regarding your use of other websites, mobile applications, and online resources.

We have implemented Google reCAPTCHA to protect our Platforms from fraud and abuse. Your use of reCAPTCHA is subject to Google’s Privacy Policy at policies.google.com/privacy and Terms of Use at policies.google.com/terms.

You may opt out of certain Cookies by changing your preference in the Cookie Preference Center or by activating the appropriate setting on your browser or mobile device. Please note that if you opt out of certain types of Cookies you may be unable to access certain parts of our Platform. The following services or organizations also offer tools that you can use to limit or opt out of interest-based advertising:

We do not control how third parties manage their opt-out processes. We are not responsible for the effectiveness of external parties’ opt out-options or programs, or the accuracy of their statements regarding their programs.

Your opt-out choice may apply only to the browser or device you are using when you opt out, so you should update your settings on each of your browsers and devices. If you opt out, you will still receive ads, but they may not be as relevant to you and your interests.

We also may provide certain in-store technologies to help personalize and improve your shopping experience. These technologies may require the collection of certain information about your mobile device, such as your MAC address or other device identification information and may also permit you to submit personal details for increased levels of personalization, such as your interests and shopping preferences.

How We Use Personal Information

We use personal information for the following purposes:

  • Provide our products and services, including to process your orders, purchases, and other transactions; present our Platforms and their contents to you; operate and maintain our Platforms; and allow you to participate in interactive features on our Platforms.
  • Improve our Platforms and services, including to facilitate and personalize your user experience, improve Platform navigation, and assess Platform performance.
  • Offer benefits and rewards, including to provide loyalty program benefits and rewards and manage participation in contests, promotions, and sweepstakes.
  • Communicate with you, including to provide you with information about our products and services; respond to and fulfill your requests; service and provide you with notices about your account or subscription, including expiration and renewal notices; and notify you about changes to any of our Platforms or products or services we offer.
  • Advertise and market, including to conduct research and analysis, including focus groups and surveys; help us personalize our services, products, and advertising; serve advertisements; send marketing and promotional communications; and measure the use of our Platforms and effectiveness of our advertising and marketing.
  • Manage quality and analytics, monitor and analyze trends, usage, and activities of visitors and users of our Platforms; repair or improve the quality of our Platforms; track and respond to quality and security issues; and develop new or enhanced products and service offerings.
  • Manage our business operations, including to perform system administration and technology management; carry out internal administration, such as recordkeeping, financial planning, and auditing; manage our relationships with our potential and current customers, partners, and vendors; and otherwise operate our business.
  • Protect the security and integrity of our Platforms, including to protect the Platforms from cyber risks; authenticate Platform visitors; prevent, identify, investigate, and respond to fraud, illegal or malicious activities, and other liabilities; enforce our policies and terms; protect our rights; fulfill our legal obligations; and secure the Platforms.
  • Comply with legal obligations and maintain compliance, including to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; manage risks, perform investigations, fulfill reporting obligations, and carry out other legal and compliance functions; comply with applicable laws, regulations, or legal process as well as industry standards and our company policies; and prevent, investigate, identify, or take any other action with regard to any suspected or actual fraudulent or illegal activity or any activity that violates our policies.
  • Manage corporate restructuring activities, including to evaluate or execute a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, as part of regular business operations or pursuant to a bankruptcy, liquidation, or similar proceeding.
  • Fulfill any other purposes, with your consent.

How We Disclose Personal Information

We may disclose personal information to the following parties:

  • Our corporate affiliates, including our parent company, sister companies, subsidiaries, joint ventures, or other companies under common control for our business operations.
  • Service providers, vendors, and other parties we use to support our business and our Platforms, including for marketing and research, website maintenance, customer service purposes, operating the Platforms, maintaining and improving our products and services, managing our promotions, processing payments, performing auditing and quality control, communicating, and otherwise operating and improving our business.
  • Business partners to provide services you have requested and to otherwise operate our business.
  • Advertising partners to perform ad targeting, remarketing, and customized advertising.
  • Insurers, auditors, and other professional advisers for the purposes of managing risks, exercising or defending against legal claims, and otherwise obtaining professional advice.
  • Law enforcement, government or regulatory bodies, or other authorized parties, including to comply with any court order, law, or legal process, such as responding to any government or regulatory request; if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Lidl US, our customers, or others, such as exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction; in the case of a suspected data breach, communicate with outside parties; assist in investigations; respond to activities that are unlawful or a violation of our Terms of Use, this Policy, or agreements with third parties; protect and defend our rights or property; or prevent or investigate crimes or potential crimes.
  • Buyers or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Lidl US’s assets – including at the negotiation stage – whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

Social and Interactive Features

Certain functionalities on our Platforms permit interactions that you initiate between the Platforms and external websites, such as social networks (“Social Features”). Examples of Social Features include “liking” or “sharing” our content and to otherwise connect the Service to a Social Feature (including to pull or push information to or from our Platforms). If you use Social Features, information you post or provide access to may be publicly displayed on the Platforms or by the Social Feature provider. Similarly, if you post information on a Social Feature website that references our Platforms (including by using a hashtag associated with us or one of our brands in a tweet or status update), your post may be used on or in connection with our Platforms or otherwise by us and/or our affiliates. Also, both we and the Social Feature provider may have access to certain information about you and your use of our Platforms and any external service. To the extent (if any) that you choose to provide information in connection with our social media platforms outside of our Online Platforms (for example, through our Facebook page), any information you provide in those settings is posted and transmitted at your own risk and subject to the terms of those social media platforms’ privacy policies.

We may engage vendors to provide certain interactive features on our Platforms. Your use of these interactive features is voluntary, and we may retain the information that you submit through these features. For example, we may offer an interactive chat feature on our Platforms to answer questions and for other customer service purposes. When you participate in the interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information obtained through the feature to provide the service on our behalf.

Mobile Devices and Applications

We may disclose personal information to our affiliates, business partners, vendors, and other parties, as further described in the How We Disclose Personal Information section. To the extent we provide these parties with access to your personal information obtained through our Apps, we require that they provide the same level of personal information protection as required by this Policy.

We will retain your personal information only for as long as we reasonably consider it necessary for achieving the purposes set out in this Policy, or for as long as we are legally required to retain it. If you no longer wish to provide your personal information through our App, you may uninstall our App from your device. Note that this action will not delete your user account or any information we previously collected via the App, nor does it affect our personal information collection through our other Platforms.

External Sites and Online Services

Our Platforms may include links to other websites that are owned and/or operated by third parties. We do not have access to or control over the privacy practices of third-party websites, and the information practices of these advertisers and third-party websites are not covered by this Policy. Lidl accepts no responsibility or liability and makes no representations about the policies of these third parties. It is your responsibility to read these third parties’ privacy policies before visiting their website or choosing to share information with them. The inclusion of a link to another website or online service does not imply our endorsement.

Personal Information Choices

Registered users can review and change certain personal information at any time by accessing their account on a Platform.

If you do not wish for Lidl to use your email address to promote our products or services, you can opt out by following the instructions at the bottom of our promotional emails, or at any other time by logging into the Website or Mobile App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes. This opt-out does not apply to information provided to Lidl as a result of a product purchase, warranty registration, product service experience, or other transactions.

If you have an account with us, you can delete your account by going into Settings within the App or website, navigating to Account Management, then click Delete Account. Once you do, the account will be removed from our Platforms.

State Privacy Disclosures

This section applies to personal information we collect and otherwise process from residents of Delaware, Maryland, New Jersey, and Virginia (collectively, “Applicable States”) under the Delaware Personal Data Privacy Act; Maryland Online Data Privacy Act; New Jersey Online Services, Consumers, and Personal Data Act; and Virginia Consumer Data Protection Act (collectively, “Applicable State Laws”).

In the event of a conflict between this section and the Policy, this section will govern Applicable State residents’ privacy rights.

Collection, Use, and Disclosure of Personal Information

We may obtain the personal information listed in the Personal Information We Collect section from sources other than the Platforms, including offline sources.

We may use and disclose personal information from other sources as described in the How We Use Personal Information and How We Disclose Personal Information sections above.

Selling and Sharing for Targeted Advertising

Under certain Applicable State Laws, a “sale” of personal information does not necessarily involve an exchange of money, but also includes the disclosure of personal information to third parties that may use the information for their own purposes, such as Cookie or other advertising technology providers. We do not sell personal information for monetary consideration, but we may share personal information for targeted advertising. We may sell personal information or share personal information for targeted advertising with advertising and analytics vendors for advertising purposes.

Your Privacy Rights

If you are a resident of an Applicable State, you may have certain rights regarding your personal information, as described further in this section.

  • Rights to Confirmation, Access, and Portability. You may have the right to confirm that we process your personal information, access your personal information, and obtain a copy of personal information in a portable format.
  • Right to Information about Third Parties. Residents of Delaware and Maryland have the right to obtain a list of the categories of third parties to which we have disclosed your personal information.
  • Right to Correct. You may request that we correct inaccuracies in your personal information.
  • Right to Delete. You may request that we delete your personal information.
  • Right to Opt Out of Sales and Targeted Advertising. You may have the right to opt out of sales and targeted advertising.

We do not use personal information for profiling in furtherance of decisions that produce legal or similarly significant effects.

To submit a request to confirm, access, obtain a copy of, correct, or delete your personal information, please submit a request using our Privacy Choices form. We may need to request additional information to verify your identity before fulfilling your request. To opt out of sales or targeted advertising, please access our Cookie Preferences link in the website footer.

We will comply with your request as soon as reasonably practicable, in accordance with applicable legal requirements. We will not discriminate against you for choosing to exercise any of your privacy rights.

If we process your personal information based on consent, you may revoke such consent by emailing Customer Care at customercarehelp@lidl.us with the subject line “Revoke Consent” and describing the circumstances under which you provided and would like to revoke consent.

If you disagree with how we handled a request, you may appeal our decision by emailing Customer Care at customercarehelp@lidl.us with the subject line “Appeal.”

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platforms, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information.

Unfortunately, the transmission of information via the internet is not completely secure. Although we take measures to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Platforms. Any transmission of personal information is at your own risk.

Children Under the Age of 13

Our Platforms are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information as required by applicable law.

Changes to Our Privacy Policy

If changes to this Policy are made, we will notify you by revising the date on this Policy. We encourage you to stay informed about our privacy practices by reviewing the Policy whenever you interact with us. In certain cases where we make material changes, we may provide you with additional notice of changes to this Policy through an email, App, or other communication, or through a banner or other notice on the Platform. Any change to this Policy will be effective immediately.

Information for Users Outside the United States

If you are accessing the Platforms from outside the United States, please be aware that information we obtain about you will be processed in the United States or in other jurisdictions. By using the Platforms, you acknowledge your personal information may be transferred to and processed in jurisdictions outside your own, as described in this Policy. Please be aware that the data protection laws and regulations that apply to your personal information transferred to the United States or other countries may be different from the laws in your country of residence.
